Conclusion of an accommodation contract in accordance with § 3
1. As a rule the accommodation contract takes effect as a consequence of the hoteliers
acceptance of a written or verbal booking on the part of the guest.
2. It may be agreed that the guest pays a deposit.
3. The hotelier may require advance payment of the entire cost of the agreed accommodation.
Time frame of accommodation contract in accordance with § 4
1. The guest is entitled to occupy the rooms stipulated in the contract from 2 p.m. of the arrival day.
2. If the guest does not check in by 6 p.m. of the agreed arrival day the hotelier has the right to cancel
the accommodation contract provided a later arrival time has not been agreed in advance.
3. If the guest has paid a deposit, however, the room reservation remains valid until
12 o´clock of the following day.
Cancellation in accordance with § 5
1. The accommodation contract may be cancelled by either party in the form of notivication by one
party up to three months before the guests stipulated arrival date without payment of a cancellation fee.
The notification of cancellation must reach the other party at least three months before the arrival date.
2. Up to one month before the stipulated arrival date the accommodation contract may be cancelled by
either party in form of notification by one party. In this case, however, a cancellation fee equivalent to
the cost of three nights accommodation is payable.
3. Even if the guest does not use the board and/or
lodging booked he is obliged to reimburse the hotelier to the amount stipulated in the accommodation
contract. The hotelier, however, must subtract from this sum the amount which he saves by not having
to render the agreed services or the amount which he receives by renting the room to another guest.
Experience shows that, on average, the hotelier saves approximately 20 per cent of the room price and
30 per cent of the catering costs.
